3.2 Payment Processing: The App may allow you to make payments for restaurant reservations or other services through third-party payment processors. By making a payment through the App, you agree to the terms and conditions of the applicable payment processor and authorize Sitme to charge your payment method for the total amount of your transaction, including any applicable taxes and fees.
3.3 Refunds and Cancellations: Refunds and cancellations are subject to the policies of the respective restaurant. Sitme is not responsible for any disputes or issues related to refunds, cancellations, or chargebacks.
4. Intellectual Property
4.1 Ownership: All content and materials available on the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the property of Sitme or its licensors and are protected by applicable intellectual property laws.
4.2 License to Use: You are granted a limited, non-exclusive, non-transferable license to access and use the App for your personal use. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the App without our prior written consent.
4.3 Trademarks: "Sitme" and our logos, slogans, and designs are trademarks of Sitme LLC. You are not permitted to use these trademarks without our prior written consent.
5. Disclaimers and Limitation of Liability
5.1 Disclaimer of Warranties: The App is provided on an "as-is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Sitme does not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
5.2 Limitation of Liability: To the fullest extent permitted by applicable law, Sitme, its affiliates, and their respective directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the App, even if Sitme has been advised of the possibility of such damages.
6. Indemnification
You agree to indemnify, defend, and hold harmless Sitme, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.
7. Termination
7.1 Termination by Sitme: Sitme reserves the right to suspend or terminate your access to the App, with or without notice, for any reason, including but not limited to your violation of these Terms, fraudulent or unlawful activity, or other conduct that Sitme deems harmful to its interests or the interests of others.
7.2 Termination by You: You may terminate your account at any time by following the instructions in the App. Upon termination, your right to access and use the App will immediately cease.
8. Governing Law and Dispute Resolution
